Florida Governor Rick Scott recently signed into law a bill that amends a state statute to preempt the state and prohibit all local regulation of hoisting equipment, unless the regulation is otherwise federally preempted by the Occupational Safety and Health Administration (OSHA) under 29 C.F. R parts 1910 and 1926. Local regulation that is prohibited and preempted to the state includes, but is not limited to, local worksite regulation regarding hurricane preparedness or public safety. The bill has no fiscal impact on state or local governments.
The Florida East Coast Chapter of Associated Builders and Contractors, (ABC) was instrumental in moving this bill through Florida’s House and Senate. The bill had broad support amongst Florida’s crane and construction members of The Florida Crane Safety Alliance (OSHA), of which Florida Crane Owners Council and ABC are members.
